1. Agreement to Terms

By downloading, accessing, or using the Eventi mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Eventi Pty Ltd ("Eventi", "we", "our", "us").

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to use Eventi.

By creating an account, you confirm that:

  • You are at least 18 years of age
  • The date of birth you provide is accurate
  • You have the legal capacity to enter into these Terms

2.2 Account Requirements

To use Eventi, you must:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any information that changes
  • Not create accounts for others or transfer your account

2.3 Prohibited Users

You may not use Eventi if you:

  • Have been previously banned from the App
  • Are a convicted sex offender
  • Are prohibited by law from using social networking services
  • Intend to use the App for illegal purposes

3. Your Account

3.1 Account Creation

You create an account by verifying your phone number and providing required profile information. You are responsible for all activity under your account.

3.2 Account Security

You agree to:

  • Keep your login credentials confidential
  • Notify us immediately of any unauthorised access
  • Not share your account with others

We are not liable for losses arising from unauthorised use of your account.

3.3 Account Termination

By You: You may delete your account at any time through Settings > Account > Delete Account.

By Us: We may suspend or terminate your account if you:

  • Violate these Terms or our Community Guidelines
  • Engage in fraudulent, harmful, or illegal activity
  • Create risk or legal exposure for Eventi
  • Have been inactive for an extended period

We will provide notice where practicable, but may act immediately where necessary to protect users or the service.

4. Using Eventi

4.1 Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

4.2 Restrictions

You agree NOT to:

Harmful Conduct:

  • Harass, bully, stalk, or intimidate other users
  • Post threatening, abusive, or hateful content
  • Engage in discrimination based on protected characteristics
  • Impersonate any person or entity
  • Deceive or defraud other users

Prohibited Content:

  • Post sexually explicit or pornographic material
  • Post violent, graphic, or disturbing content
  • Post content that exploits or endangers minors
  • Post spam, advertisements, or solicitations
  • Post malware, viruses, or malicious code

Platform Abuse:

  • Use bots, scrapers, or automated tools
  • Circumvent security or access controls
  • Reverse engineer or decompile the App
  • Interfere with the App's operation
  • Access data you are not authorised to access

Illegal Activity:

  • Use Eventi for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe intellectual property rights
  • Facilitate illegal transactions

4.3 Rooms and Events

When creating or joining Rooms:

  • Hosts are responsible for their Room's conduct
  • Hosts may set audience preferences (e.g., Women Only) for safety purposes
  • Attendance is at your own risk
  • Eventi does not verify event details or attendees
  • Eventi is not responsible for real-world interactions

4.4 Messaging

  • Do not send unsolicited, harassing, or spam messages
  • Message requests require acceptance before conversation
  • Do not share others' private information without consent

5. User Content

5.1 Your Content

"User Content" means any content you post, upload, or share on Eventi, including profile information, photos, posts, comments, messages, and room details.

You retain ownership of your User Content. By posting, you grant Eventi a worldwide, royalty-free, sublicensable licence to use, copy, modify, display, and distribute your User Content for the purpose of operating the App.

5.2 Content Standards

Your User Content must not:

  • Violate these Terms or Community Guidelines
  • Infringe any third party's rights
  • Contain false or misleading information
  • Be illegal, harmful, or offensive

5.3 Content Removal

We may remove User Content that violates these Terms, without notice. We are not obligated to store or maintain your content.

5.4 Content Responsibility

You are solely responsible for your User Content. We do not endorse or verify User Content and are not liable for any content posted by users.

6. Intellectual Property

6.1 Our Property

The App, including its design, features, code, trademarks, and content (excluding User Content), is owned by Eventi and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our written permission.

6.2 Feedback

If you provide feedback, suggestions, or ideas about Eventi, you grant us the right to use them without compensation or attribution.

7. Third-Party Services

7.1 Event Data

Eventi displays event information from third parties (e.g., Ticketmaster). We do not guarantee the accuracy of this information. Ticket purchases are made directly with third parties and subject to their terms.

7.2 Links

The App may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or terms.

7.3 App Stores

Your use of the App is also subject to Apple's App Store Terms of Service.

8. Safety and Reporting

8.1 Your Safety

Eventi is a platform to connect people. We cannot guarantee user behaviour. You are responsible for your own safety when interacting with others, especially at in-person events.

Safety Tips:

  • Meet in public places for first meetings
  • Tell someone where you're going
  • Trust your instincts
  • Do not share sensitive personal information
  • Report suspicious behaviour

8.2 Reporting

You can report users or content that violates these Terms or Community Guidelines. We will review reports and take appropriate action.

You agree to cooperate with any investigation into violations of these Terms, including providing information when requested.

9. Disclaimers

9.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The App will meet your requirements
  • User Content is accurate or reliable
  • Any defects will be corrected

9.2 User Interactions

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE. You assume all risk when interacting with other users.

9.3 Events

WE DO NOT ORGANISE, HOST, OR VERIFY EVENTS OR ROOMS. We are a platform for users to connect. Attendance is at your own risk.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVENTI SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage arising from your use of the App
  • Conduct of other users, whether online or offline
  • Unauthorised access to your account or data
  • Errors, omissions, or inaccuracies in the App

10.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.

10.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

11. Indemnification

You agree to indemnify and hold harmless Eventi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your interaction with other users

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia.

12.2 Informal Resolution

Before initiating formal proceedings, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

12.3 Jurisdiction

Any disputes not resolved informally shall be resolved in the courts of New South Wales, Australia. You consent to the exclusive jurisdiction of these courts.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Sending a notification (for significant changes)

Your continued use of Eventi after changes constitutes acceptance. If you do not agree with changes, stop using the App and delete your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Eventi.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

14.5 No Agency

Nothing in these Terms creates any agency, partnership, or joint venture between you and Eventi.
